Immigration and Foreigners Law in Argentina

As immigration lawyers in Buenos Aires, we assist foreign nationals of all nationalities in the process of settling in Argentina. We handle temporary and permanent residencies across all categories -- work, study, investment, rentista, retirement, MERCOSUR and family reunification -- before the National Immigration Office (DNM). We evaluate each case to determine the most suitable immigration category and guide clients through the entire process until they obtain their DNI (national ID for foreigners).

Our team of immigration attorneys advises on obtaining Argentine citizenship by naturalization, representing applicants before the federal courts in the citizenship application process. We also assist with citizenship by option and through marriage, apostille of documents, and legalization before national and international agencies.

We represent refugee applicants before CONARE and defend foreign nationals facing deportation proceedings, immigration detention, or entry bans. Our experience covers all immigration categories under Argentina's Immigration Law 25.871, including precarious residency, change of immigration category, and regularization of irregular immigration situations.

Frequently Asked Questions

Argentina offers several visa categories depending on your purpose of stay: tourist visa (90 days, extendable), temporary residency (for work, study, investment, retirement, rentista, family reunification or MERCOSUR nationality), permanent residency (after 2-3 years of temporary residency), and transitory residency (digital nomad, business, transit). Each category has specific documentary requirements. A valid passport, criminal background check and proof of domicile in Argentina are common to most categories.

Requirements vary by category. For MERCOSUR nationals, proof of nationality is sufficient. For non-MERCOSUR applicants, a specific criterion is needed: employment contract, investment, passive income, enrollment in an educational institution or family ties with an Argentine citizen or resident. All applicants must present a valid passport, criminal background check from their country of origin and from Argentina, proof of domicile, and health insurance. The process is managed through the DNM (National Immigration Office) via the RaDEx platform.

To move to Argentina legally, you need to obtain a residency permit through the National Immigration Office (DNM). The most common paths are: MERCOSUR residency (for South American nationals), work visa (with an employment contract), investor visa (with a productive investment), rentista visa (with passive income equivalent to 5 minimum wages), student visa, or family reunification. Once granted temporary residency, you receive a DNI (national ID) and CUIL/CUIT (tax ID), allowing you to live, work and access public services.

Argentine citizenship by naturalization requires at least 2 years of continuous legal residency, proof of lawful income and good conduct. The application is filed before the federal court. It can also be obtained by option (for children of Argentines born abroad) or facilitated through marriage with an Argentine citizen. Argentina allows dual citizenship and does not require renunciation of your previous nationality.

If you receive a deportation order from the National Immigration Office, you have the right to file administrative and judicial appeals to challenge it. It is essential to act quickly and retain an immigration lawyer to evaluate the grounds for deportation, file the appropriate appeals and request injunctive relief to suspend the enforcement of the order. Entry and exit bans can also be lifted through legal proceedings.
