Argentine nationality for foreigners: legal pathways to obtain it

Argentine law provides several pathways for foreign nationals to obtain citizenship. The most common is naturalization, which requires at least two years of continuous legal residency in the country, along with proof of ties to the community, lawful income and good conduct. The process is managed through the National Immigration Office and/or the competent authority, depending on the case.

In addition to naturalization, there is citizenship by option, which is the right of children of Argentines born abroad to obtain Argentine nationality. Recently, Argentina introduced citizenship by investment, which allows foreigners who make significant investments to access an expedited naturalization process. Argentina allows dual or multiple citizenship, meaning that the naturalized citizen does not need to renounce their original nationality.

Our firm advises and represents foreign nationals throughout the entire citizenship process, from evaluating the most suitable pathway to filing the application before the court and following up until the document is obtained. We also assist with the apostille and legalization of foreign documentation required for the process.

Procedure

Citizenship process: step by step

The procedure is managed through the National Immigration Office and/or the competent authority, depending on the case. It involves several stages that must be completed in order to obtain a favorable resolution.

Case evaluation

We analyze the applicant's immigration status, verify that the residency requirements are met and gather the necessary documentation: birth certificate, criminal background check, proof of residency and evidence of lawful income.

Document preparation

We arrange for the official translation of foreign-language documents, the apostille or consular legalization as applicable, and the procurement of updated criminal background and domicile certificates.

Application filing

We prepare and submit the citizenship application before the National Immigration Office or the competent authority, accompanied by all required supporting documentation.

Evaluation and integration

The authority evaluates compliance with the requirements, including verification of ties to the community and integration.

Resolution and oath

If the requirements are deemed satisfied, a resolution granting citizenship is issued. The new citizen takes an oath of loyalty to the National Constitution and may then apply for the DNI and the Argentine passport.

Legal framework

Argentine citizenship requirements

Law 346 on Citizenship and Naturalization establishes the requirements for obtaining Argentine nationality by naturalization:

  • At least 2 years of legal and continuous residency in Argentine territory
  • Proof of lawful income (employment, business or professional activity)
  • Good conduct, evidenced by a criminal background certificate
  • Demonstrated ties to the community and integration

Article 20 of the National Constitution enshrines the right of foreigners to obtain naturalization after two years of continuous residence in the Nation, even allowing the authority to shorten that term in favor of those who can allege and prove services rendered to the Republic.

Argentina recognizes dual citizenship. The naturalized citizen is not required to renounce their original nationality, unless the legislation of their home country requires it.

Common questions

Frequently asked questions

Argentine citizenship by naturalization requires at least 2 years of continuous legal residency in Argentina, proof of lawful income, good conduct and demonstrated ties to the country. The application is filed before the competent authority. Once granted, the naturalized citizen acquires the same rights and obligations as a native Argentine, including the right to vote and obtain an Argentine passport.

The main requirements are: at least 2 years of legal and continuous residency in Argentina, proof of lawful income, good conduct, and demonstrated integration into the community. Additionally, identity documents must be translated and legalized. The process is managed through the National Immigration Office and/or the competent judicial authority.

The naturalization process takes on average between 6 months and 1 year from submission, depending on the jurisdiction and the caseload of the intervening authority. The timeline may vary if additional reports are required or if documentation needs to be completed.

Marriage to an Argentine citizen does not automatically grant citizenship, but it facilitates the process. A foreign spouse can apply for temporary residency through family reunification, and after 2 years of legal residency, apply for naturalization. The marriage must be legally recognized in Argentina.

Yes, Argentina allows dual or multiple citizenship. A foreigner who becomes naturalized Argentine is not required to renounce their original nationality, unless their home country's legislation requires it. Likewise, an Argentine who acquires another nationality does not lose their Argentine citizenship. This makes it easier for naturalized citizens to maintain legal ties with their country of origin.
