Legal counsel for obtaining the O-1 visa for individuals with extraordinary ability.
The O-1 visa is intended for individuals who demonstrate extraordinary ability in sciences, arts, education, business or sports, or outstanding achievements in the motion picture or television industry. It is divided into O-1A (sciences, education, business, sports) and O-1B (arts, film and television). The applicant must demonstrate sustained national or international recognition in their field.
Unlike other work visas, the O-1 has no annual issuance cap. It requires a petition (Form I-129) filed by a U.S. employer or agent with USCIS. Essential support personnel may accompany the principal beneficiary on an O-2 visa. The evaluation criteria include awards, publications, memberships in associations of excellence, original contributions and high compensation.
Initial period of up to 3 years. Extendable in 1-year increments with no maximum limit, as long as the activity continues. It does not directly lead to a green card, but it is compatible with permanent residency processes.
