K and V category visas are intended for fiances, spouses and direct family members of US citizens and permanent residents. The K-1 allows the fiance of a US citizen to enter the United States with the obligation to marry within 90 days of arrival. The K-3 allows a citizen's spouse to enter while their permanent residency is being processed. The V visa is intended for spouses and children of permanent residents with a family petition approved more than 3 years ago.
The process begins with a family petition (Form I-130 for K-3/V, or Form I-129F for K-1) filed by the US citizen or permanent resident with USCIS. Once approved, the beneficiary applies for the visa at the US consulate. Minor children of the principal applicants may accompany them with a K-2, K-4 or derivative V visa.
K-1: 90 days to get married (then adjustment of status is filed). K-3: until permanent residency is obtained. V: until the immigrant visa number becomes available.
