Treaty investor visa (E-2)

The E-2 visa allows nationals of countries that have a bilateral investment treaty with the U.S. to reside and work in the country while directing a business in which they have made a substantial investment. Argentina has a current investment treaty with the United States, which enables Argentine citizens to apply. The investment must be substantial, active and generate employment beyond the sustenance of the investor and their family.

The applicant must demonstrate operational control of the business and that the investment is not marginal. The E-2 principal's spouse may obtain work authorization (EAD) in the United States. Dependent children under 21 years of age may accompany the principal on an E-2 dependent visa.

Main requirements

Duration and renewal

Initial validity of up to 5 years. Indefinitely renewable as long as the requirements are maintained. It does not lead directly to permanent residency (green card), but can be combined with other pathways.
