Permanent residence based on rootedness is provided in Decree 616/2010, Clause “c”, as a regulatory evolution of the “Residence Agreement for Mercosur Nationals” (Law 25.903). This criterion allows the transformation of temporary residence into permanent residence, provided it is requested within the established deadlines: 60 days before the expiration or up to 30 days after, with an additional fee.

For nationals of Mercosur or associated countries, at least two years of temporary residence is required. For foreigners from other nationalities, the requirement is three continuous years. It must also be demonstrated that the temporary residence was effectively enjoyed according to the national immigration register.

This residence category also covers special cases such as diplomats, who must submit specific documentation issued by the Ministry of Foreign Affairs.
